Drug DUI

Drug DUI Lawyer in San Bernardino

Identifying the Weaknesses in Drug DUI Cases Since 2005

Drug DUI charges are built differently than alcohol DUI charges. There’s no fixed number to dispute, no 0.08% threshold that defines guilt or innocence. The prosecution relies instead on officer observations, field sobriety test results, and Drug Recognition Evaluator opinions. That structure leaves more room for challenge, and identifying those weaknesses is exactly what we do. Bullard & Powell, APC. is based in San Bernardino with over 30 years of combined legal experience defending clients across the greater Inland Empire.

How California Law Defines Drug DUI

California’s Vehicle Code addresses drug-impaired driving through three distinct misdemeanor charges. Vehicle Code 23152(f) prohibits driving under the influence of a drug. Vehicle Code 23152(c) prohibits driving while addicted to a drug. Vehicle Code 23152(g) covers driving under the combined influence of alcohol and a drug. Each carries the same core question: was the driver’s ability to operate a vehicle safely impaired?

Unlike alcohol DUI, drug impairment has no per se limit under California law. A chemical test result doesn’t resolve the case the way a breath test reading does. Officers piece together a case from physical signs, behavioral observations, and blood or urine test results. Two points matter here:

  • Prescription drugs count. A valid prescription isn’t a defense if the drug impaired your driving.
  • Legal marijuana counts. Recreational cannabis use is lawful in California, but driving while impaired by it is still a chargeable DUI offense.

When a Drug DUI Becomes a Felony

Most first-time drug DUI arrests are charged as misdemeanors. Two circumstances change that. First, if the driving caused injury to another person, Vehicle Code 23153 elevates the charge to a felony under subsections (f) and (g), depending on the substance involved. Second, a charge that would otherwise be a misdemeanor can be filed as a felony if the driver has three prior DUI convictions within the past 10 years or carries a prior felony DUI conviction on their record.

Felony DUI causing injury carries state prison time, substantial fines, and a lengthy license suspension. If your case involves either escalating factor, how your defense is built from day one matters enormously.

How San Bernardino Officers Build a Drug DUI Case

San Bernardino law enforcement runs DUI checkpoints on heavily trafficked routes including Interstate 10, Interstate 215, Highland Avenue, and Baseline Street. Officers who stop a driver they suspect is impaired by drugs typically move through a documented process before making an arrest.

Field Sobriety Tests & DRE Evaluation

Standard field sobriety tests designed for alcohol aren’t reliable indicators of drug impairment, so officers trained as Drug Recognition Evaluators (DREs) conduct a separate 12-step evaluation. A DRE examines pupil size, muscle tone, vital signs, and other physical markers to form an opinion about whether the driver is impaired and by what category of drug. That conclusion is an opinion, not a scientific measurement, and it can be challenged on methodology, the evaluator’s training record, and the conditions under which the evaluation was conducted.

Chemical Testing

Blood or urine samples typically follow a drug DUI arrest. These results carry weight at trial, but they aren’t bulletproof. Chain-of-custody errors, sample contamination, improper storage, and flawed testing procedures are all grounds to challenge the results. When the evidence doesn’t hold up under scrutiny, the prosecution’s case can weaken considerably.

Where Defense Opportunities Arise

Drug DUI cases in San Bernardino are heard at the San Bernardino Justice Center, where the Criminal Division of the Superior Court sits. Outcomes range from dismissal to a reduced charge. A wet reckless plea, which downgrades a DUI to reckless driving under Vehicle Code 23103, is one negotiated resolution that can avoid the full consequences of a conviction. Whether any particular outcome is achievable depends on the facts, but the absence of a per se limit means the evidence is more contestable here than in a standard alcohol DUI.

How We Handle Drug DUI Defense

Jeffrey Bullard and Sarah Powell handle every case directly. No junior associates, no handoffs. From the first strategy conversation through resolution, you work with the attorneys whose names are on the door. Jeffrey received the Avvo Client’s Choice Award specifically for DUI defense, and both partners bring strong familiarity with the local judges and district attorneys who may handle your case at the San Bernardino Justice Center.

Every case we take is prepared as if it’s going to trial. That preparation isn’t a formality. It creates real leverage in plea negotiations and sends a clear signal to prosecutors that we aren’t looking for a quick exit. Drug DUI charges, with their reliance on subjective evaluations and chemical testing chains, offer more contestable openings than most charge types. Building a defense around those openings is how we work.
