Drug Manufacturing Defense in San Bernardino

Founding-Partner Representation for Serious Felony Charges

Drug manufacturing allegations are felony charges that can expose an accused person to significant prison time and fines. At Bullard & Powell, APC., founding partners Jeffrey Bullard and Sarah Powell remain directly involved from the first contact through the resolution of the case, with no handoffs to junior associates.

Our attorneys bring more than 30 years of combined criminal defense experience to allegations involving laboratory operations, unlawful cultivation, chemical extraction, and drug production. We examine the circumstances of the arrest and the evidence supporting the charge, then develop a defense based on the specific facts.

California Drug Manufacturing Charges Under Section 11379.6

California Health and Safety Code section 11379.6(a) prohibits manufacturing, compounding, converting, producing, deriving, processing, or preparing specified controlled substances. The statute applies whether the alleged activity occurred directly or indirectly through chemical extraction or synthesis.

Drug manufacturing generally means producing or creating an illegal drug. Allegations may involve synthesizing methamphetamine, operating a chemical laboratory, extracting concentrated cannabis with a solvent, or unlawfully growing marijuana. Subdivision (e) also applies to an offer to perform conduct punishable as manufacturing, even if prosecutors don’t claim that production was completed.

A manufacturing allegation concerns claimed participation in producing or preparing a controlled substance, while possession concerns control over a substance. Equipment, chemicals, plants, messages, laboratory analysis, and the accused person’s connection to a property may affect which conduct prosecutors allege.

Potential Penalties for Drug Manufacturing

A conviction under the statute carries a potential term of three, five, or seven years of imprisonment under Penal Code section 1170(h). The court may also impose a fine of up to $50,000. An offer-based violation under subdivision (e) carries a potential term of three, four, or five years.

Those statutory ranges don’t predict the sentence in an individual case. Felony sentencing depends on the filed charge, admissible evidence, proven allegations, criminal history, and other case-specific circumstances.

The law identifies circumstances that a sentencing court may consider as aggravating factors:

  • For certain methamphetamine-related violations, a child under 16 resided in the structure where the offense occurred.
  • An alleged methamphetamine manufacturing violation occurred within 200 feet of an occupied residence or structure where another person was present.
  • Volatile-solvent extraction of concentrated cannabis occurred within 300 feet of an occupied residence or structure where another person was present.

Defense Issues in an Alleged Manufacturing Operation

A charge isn’t proof that the accused knowingly participated in drug production. Mere presence at a property or proximity to laboratory equipment isn’t the same as manufacturing a controlled substance. The prosecution must present admissible evidence connecting the accused to the claimed operation.

We review the circumstances of the arrest, the government’s theory of production, and the following potential issues:

  • Knowledge: Whether the accused knew about the alleged production activity or the purpose of the materials.
  • Participation: Whether evidence connects the accused to manufacturing rather than simply to a property, vehicle, or another person.
  • Search and seizure: Whether officers lawfully obtained and executed a warrant or relied on a valid exception to the warrant requirement.
  • Production evidence: Whether laboratory findings and physical evidence establish actual manufacturing activity.

We prepare every case as if it’ll proceed to trial, including cases resolved outside the courtroom. This approach allows us to test the prosecution’s factual and legal positions through investigation, motions, negotiations, and trial when necessary. We have secured dismissals for clients facing multiple serious felonies by identifying weaknesses in the prosecution’s arguments before trial, although every case depends on its own evidence.

The Criminal Case Process in San Bernardino

A case may begin with an investigation, the execution of a search warrant, or an arrest. Prosecutors then decide which charges to file. At the arraignment, the accused is formally advised of the charge, enters a plea, and receives the court’s decision on applicable release conditions.

Early evidence review may cover the stated basis for the search, the claimed production method, laboratory analysis, seized communications, and the connection between the accused and the alleged operation. The case may then proceed through motions or negotiations. If it doesn’t resolve beforehand, it can proceed to trial.

We stand beside our clients from the first call through the conclusion of the case. Our familiarity with local judges and district attorneys informs how we evaluate allegations, prepare for court appearances, and present the defense. Available resolutions depend on the evidence, filed charges, and individual facts.
